United Nations CRPD Intervention for Garth Daniels

Under the Optional Protocol of the United Nations Committee on the Rights of People with disabilities (CRPD) Garth Daniels should never have been subjected to electroshock against his will. Finally, Garth is getting the International intervention needed to stop this brutal attack on his life.

Australia is a signature to the UN CRPD Optional Protocol and has ratified this. Under article 4 on which the UN is intervening in the brutal EST on Garth Daniels.

1. At any time after the receipt of a communication and before a determination on the merits has been reached, the Committee may transmit to the State Party concerned for its urgent consideration a request that the State Party take such interim measures as may be necessary to avoid possible irreparable damage to the victim or victims of the alleged violation.

This intervention has occurred after 20 years of forced psychiatric treatments and commitments, for Garth Daniels, as well as 5700 other Victorians every year, that refuse psychiatric treatments and are then said to not be able to give Informed Consent.

Garth’s father, Mr Bernard Daniels has been supporting Garth in human rights under UN CRPD law, for all those twenty years his rights have been denied. Many rights, and most obviously article 15:

No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment. In particular, no one shall be subjected without his or her free consent to medical or scientific experimentation.

Psychiatrists have declared that Garth Daniels cannot give informed consent, because anyone who disagrees with a psychiatric treatment regime is said to lack insight into their illness and thereby said not to be able to give Informed Consent.

Through a habeas corpus writ Garth was able to appear in court, despite Upton House psychiatrics declaring he was too ill to have visitors.

Bernard Daniels made a plea for his son to speak, to prove his ability to communicate and thus give informed consent:

 pressed for time.

MR B DANIELS: Two minutes, Your Honour.

HIS HONOUR: Two minutes?

MR B DANIELS: Two minutes.

HIS HONOUR: Yes, very well, Mr Daniels.

MR G DANIELS: Thank you, sir. Sir, I have had no freedom of consent guaranteed me. I have been shocked sometimes and it is my wish and will that I be discharged to undertake alternative treatment. I have had all leave from the hospital cancelled and my family and friends are not allowed to visit me in hospital. Only my mum and my brother. My dad, I told him to act on my behalf. My dad is the person I nominated to speak to the doctors about my treatment. My dad is my medical Power of Attorney, but the doctors won't allow him into the hospital to speak with me. I love my mum and my dad and my brother and only managed to hug my dad after months just two days ago in court. I want to be with my family.

‘I am imprisoned against my wishes and spend 24 hours in a locked ward. The power points in my room don't work so I can't play my radio or charge my phone. Most of my time I spend reading my photography books, and after court the other day the nurse wanted to take away my mobile phone so my dad could not phone me and interfere, the nurse said. I told my brother and he passed that message to our dad who said they can't restrict my communication simply because I want to speak to my dad. My phone has been taken away from me. I was encouraged by one of the psychiatrists, Dr Sarah Mackay, to enrol in my photography course which I waited for a whole year to enrol. This was at Holmesglen College of TAFE near our house. I was one of 20 people to be accepted into the photography course and then my treating psychiatrist cancelled my leave after I attended just one class and got back late from leave. They gave me shock treatment against my wishes. I told the doctors and the nurses I do not consent and that I'm under duress, which means I'm being forced to have ECT, the shocks.

‘Once I got leave and went to the police station to tell them I am being shocked against my consent and my wishes, the police told me to fill in a form and keep it. It's a statement signed by me in the police station at Box Hill. I have got those forms with me today, sir, and I can show it to you. Now the doctors keep harassing me to change my medication when I'm happy with the current medication that I'm taking. They tell me I have a mental illness and I must take medication, which I accept. I'm happy with my medication which has no bad effects on me and I am stable, but the doctors keep harassing me to take other medication. My current medication keeps me well, as the nurses keep saying I'm doing well, but the doctors still tell me it's the shock treatment keeping me well. But I don't like shock treatment because it is affecting my memory and the doctors won't tell me when the shocks are going to stop. The nurses tell me I've had more than 60 shocks. I just don't know how many, but my head hurts and my teeth ache, and the shocks still continue even when I say I'm under duress and don't consent to ECT.

‘My memory is getting very bad and I seem to forget things. I am now fearful in hospital and intimidated because, if the nurses just think I did something wrong, they call police who demand I get in my bed, then the nurses strap me in a four-point restraint because they say I am aggressive. I am not aggressive and I am well now, but they still tie me up whenever they think I look or act aggressively, which I do not. My brother tells me that at one stage I spent more than 60 days strapped to a bed because they said I was violent. Was I violent is a difficult question to answer as I don't know what they mean by being violent as my memory is not so good anymore because of the shocks, I know it. I hate that the doctors don't accept that I can't explain the procedure about ECT, how they put paste on the side of one's head, then they put a needle in your arm and put patches on your chest which monitors your heart. Then they give you an anaesthetic to make you unconscious and shock you. I don't know how it is supposed to work because all it does is keeps on making my memory bad which must mean it's affecting my brain because I'm beginning to forget things sometimes, much more than before, and I'm only 40 years young.

‘I'm not allowed out of hospital, I'm not allowed to go home, I have no leave, I can't have lunch with my dad and I don't know when they're going to stop shocking me. I'm scared they're going to shock me to death. I have a private psychiatrist who is happy to treat me and I was told that Dr Katz was going to allow me to go to Queensland, but instead on Monday I got electric shocks. I don't want any more and just want to be discharged to my private psychiatrist in Queensland. My parents are preparing to move to Queensland and this is good as my private psychiatrist, Dr Jock McLaren, came to see me in hospital. Dr Jock promised me he would take over my care when I get to Queensland. I just want to go home and not be shocked any more and to go to Queensland with my parents so that Dr Jock McLaren can be my psychiatrist. Please, I want to be discharged with no more shocks. I fear the shocks will kill me. Thank you, sir.’

The Supreme Court allowed Upton House to continue to force electroshock on Garth Daniels since March 22^nd 2016 and the Daniels family had to pay court costs. A total 90 electroshocks on Garth against his will, he has been battered with. And threats of more, despite two  independent psychiatrists agreeing with Garth that further electroshock will not be therapeutic for Garth and that it is feared that it might kill him.

Despairing of how-to free stop Garth from being killed the family and advocates appealed to the United Nations on the 29^th March.

The United Nations, have been meeting to look at Absolute Prohibition of forced treatment and commitment.

The UN intervened on 2^nd April, on behalf of Garth Daniels, demanding a halt to any further forced medicine on Garth Daniels. This sets a precedent for all Australians being abused by psychiatry, which amounts to around quarter of the population, many of whom do not even know they can appeal to the Supreme Court, don’t have the money to take such action, as well as those who are suffering under psychiatric forced treatments and are not aware of their rights.

No person, not even a criminal, should be subjected to torture, that’s clear – most people in the street if asked would know that. Yet Garth, an innocent man, has been subjected to forced treatment and commitment. Forced treatments, such as drugs and electroshock fall under the definition of torture, as do psychiatric mechanical holds. When a person has never been charged with a crime, and the label of ‘disability’ allows psychiatrists to torture a person, this is terrible. Medicine is meant to enable, not disable.

While hope for Garth’s recovery of memory will be there for his family, it may be that much of his former abilities may not ever be what it could’ve been. Tragedy of losing ability, happens – but when it is a government approved hospital run by doctors who are supposed to do no harm, and yet actively and willingly commit harm against a person’s wishes, that’s incredibly wrong. And, it is against International Law Australia has signed and ratified.

The Australian Medical Association, really has to ask itself if affiliating with psychiatric abuse is what their organisation can continue to do, without needing to compensate victims of psychiatry. Now, that we have a precedent Intervention & investigation to stop forced treatment, it is time for the AMA to step in and say no more to forced psychiatric treatments and commitments.

Why are psychiatrists given more power than an elected Minister?

An elected minister cannot lock you up and torture you, a psychiatrist can. Who gave them this power?

Ugly regime

An ugly mongrel group of people gained authority from my government to threaten me, humiliate me, attempt to brainwash me, then torture me by injecting various chemicals into my blood-stream for nearly 14 years.

I was afraid to speak about who they were lest people judge me, not employ me, or condemn me to further assaults on my body, that could include electrocution and lengthy captivity.

It is an horrific regime that still thrives in my country. Please find a way to stop the cult of psychiatry infiltrating government policy. This regime of terror is not medicine, it is a crime against humanity. It must be stopped. The regime’s propaganda may make you victim-blame, criminalising the innocent (some of psychiatry’s victims are younger than two years old, many are women or teenagers who have been bullied and violently abused.) June 26 is the International Day in Solidarity with Victims of Torture

On June 26^th the mainstream media must talk about psychiatric abuse, otherwise they’re being extremely insensitive by neglecting to do so. Psychiatric survivors need validation.

There must be huge recognition, on June 26th of the torture regime psychiatric survivors suffered, are suffering, and those who have died from it, as well as those who comply with the brain-washing, because they have little choice now they are addicted to cocktails of harmful psych drugs. The 25 years that are taken away, the abilities that are destroyed, the disabling of so many by force. It is the use of force, in psychiatry, that must stop.

Most psychiatric survivors have never committed a crime, but they are victims of crime. Society punishes those grieving, unless the grieving person has support. Support for those that are unusual, different, before their time, is not a given in most societies, especially Australia. Australia has a tendency to alienate diversity. Alienating a person, causes grief. People want and need to connect to the rest of society, and it is distressing when they cannot because of societal fears and prejudices based on ugly regimes that do not help society ameliorate, or improve society's ethics.

Australia has signed the United Nation’s CRPD. This means that use of psychiatric force on citizens of this country who have not committed a crime, is illegal.

Victoria wants to continue electrocuting children

Do not allow the state of Victoria (Australia) to continue its barbaric practises. It's amazing how psychiatrists and their cult following, can claim using Propofol (the drug that killed Michael Jackson)  to knock a child out, every week for at least 10 consecutive operations of brain-damaging electrocution can be called 'health care'. Especially when the children suffering emotional crisis, alienation, grief, have not had their truths witnessed or validated. Perhaps abuse hasn't even been stopped, rather the child is made to feel they're 'wrong', 'faulty' and must be punished with electrocution like a US mass murderer on death row, and must 'put up with' the other abuses as well.

Victorian people must gain understanding of what they're doing to children, who do not want to be harmed this way, who are often victims of crime, or suffering loss, or had trauma while they were in the womb.

Around 2 million Australians every year are forcefully ‘treated’ by psychiatry (drugging, repeated sessions of electroshock under anaesthetic, psychosurgery...) Government money saving suggestion

The drain on the economy, is the backward government subsidised profession of psychiatry

I think if governments could stop spending money forcing psychiatric drugs on unwilling people and stop paying psychiatrists’ wages, the country could save so much, and they would be stopping psychiatric abuse and complying with International Laws against torture.

Apart from the obvious human-rights abuses that occur with these forced psychiatric treatments (brain-damage, damage to nervous system etc) people who are on psychiatric drugs have to sleep long hours that make getting up for work impossible, using machinery/ driving hazardous... Enable them rather than disable them, I say, and they're part of the workforce, contributing to making a healthy economy.

A crisis doesn't have to last a person's lifetime. It usually does when a person's trauma gets called a 'mental illness', a 'disease', as nonsense...

Change the law by complying with international agreements Australia has signed. That doesn't cost anything, so, what is the problem? Why can’t governments like Australia comply with decency and not experiment, torture and dehumanise people in crisis?

There is a matter of biopsychiatrists losing their jobs or having to retrain in other professions, where they don't need to be compassionate, caring, or helping another. But, redundancy happens in a lot of professions. Why should psychiatrists be immune when they aren't competitive, or meeting the consumer's needs, rather violating them?

The drain on the economy is psychiatrists, not those people psychiatrists are allowed to use violently as 'subject matter'. Unfortunate psychosocial situations, transgenerational trauma and suffering the social prejudice of others, are not diseases! But it is useful to hospital projects that they can use this term ‘disease’. It invokes fear in the population, that word.

People lose confidence when going through crisis and they can't get jobs, when they are falsely labelled by psychiatry. Active discrimination happens all the time, as people can 'tell' you're on psych drugs, or 'something', Tardive Dyskinesia makes you look like you've been in psychiatric hospital... Active discrimination happens for anything people don't understand.

There are better options to give people in crisis, so give them. Further abuse, via biopsychiatry of people alienated and traumatised, never helps. At the moment, the current system that 'cares' for those going through internal dilemmas, is one of further accusation and damning of that person, rarely validating horrific crimes people have suffered. I want this kind of biopsychiatry to stop ruling people's lives with its cruel regimes of torturous 'treatments’, its threats, accusations and damning of human lives.

Push people into corners and they do what they do to fight. Stop psychiatric abuse, ie forced drugging and electroshock and start allowing people to exist. It's not easy to get a flat that won't be invaded by the CAT team. It's not easy to get any shelter for long, without that invasion occurring, if perceived 'necessary', when it's not. Just because a person is talking usual experiences, doesn’t mean that person should be used by psychiatrists for inhumane experiments.

People who are abused, do what they can to cope, and of course they're angry. Psychiatry has tortured them, and their society doesn't even recognise that as abuse, calls it 'care'. That’s not okay. If you’re a person who has been saying that, please realise where you have been going wrong and change your unthinking attitude. The sooner people start listening, rather than reciting propaganda, the better. So, please get better!

Australian politicians who want to stop psychiatric abuse

I have narrowed this search down to my electorate, Melbourne Ports, this includes all the Senate candidates for Victoria, but only the House of Reps for Melbourne Ports, for the Sept 2013 election.

If anyone from other areas wants to collaborate or comment on their area, with candidates who are going to do something about stopping forced-drugging, electro-shock and other psychiatric abuse, I would be most interested.

That said, I am aware that the Socialist Alliance has this written on their website, ‘The Socialist Alliance will guarantee patients' control by legislating the right of access to all information required for informed consent; the right to appoint a legal guardian of a patient's choice; the right to choose or refuse medical treatment; the right to choose contraception appropriate to the patient and abortion as required. Hospitals to be forced to admit their surgical, pharmacological and other nosocomial mistakes as a matter of due process.’

            This sounds promising, but they are not running in either Senate for Victoria, or House of Reps in Melbourne Ports. They are, however, running in other electorates.

The Optional Protocol to the Convention against Torture (OPCAT) is an international agreement designed to protect people in detention from cruel, inhuman or degrading treatment or punishment. It ensures that these facilities can be independently monitored and inspected. We will commit $15 million over the next four years to ratify the convention and protect the vulnerable in detention.

As you probably know, Greens Senator Richard Di Natale is a medical doctor and has been responsible for many important initiatives - re preventative health, problem gambling, junk food.

I am not aware of any specific actions re abuse, but in general the Greens work and policies on mental health issues is very strong and supportive, standing up for more funding and some important specific initiatives.

I am surprised with this miniscule result in return replies.

Those against psychiatric torture regimes comprise of at least 5% of the vote. This could be a major win for a party or independant. Those who are ignorant and could be made aware of this major abuse of human-rights, comprise of more than 20% of the vote.

Psychiatric survivors, activists, compassionate individuals, those diagnosed and incarcerated in hospitals for no crime… our voice needs to be heard, recognised, validated and the horror of psychiatric abuse needs to stop. We have the United Nations backing us. Why do Australian political parties that have policies regarding human-rights claim such ignorance of what happens on their doorstep? of what can happen to anyone who goes through trauma, crisis who doesn’t get enough support and validation for their suffering?

Do politicians not know how cruel toxic drugs such as neuroleptics are, that shut down neurotransmitters so a youthful person feels like they have Alzheimer’s, so they twitch uncontrollably, sleep most of the day? Can’t they imagine how horrible it is to lose your memory during the 40 or so bouts of ECT that a psychiatrist recommends and forces on individuals without their consent?

Psychiatric abuse needs to stop. I want parties who will back us, who advertise this policy to stop psychiatric abuse properly. I want politicians who are loud and clear that they will stop force-drugging, electro-shock and other invasive procedures. It will be a major win for whoever does this. Whoever goes into hospitals and lets those being tortured by psychiatrists know that they should vote, because their party is going to stop the horror of psychiatric abuse.

I am surprised so many Australians still believe that biological psychiatry, is the social-psychiatry of Hollywood movies. No, psychiatrists rarely talk or listen to patients, they mandate, brainwash and forcefully drug and electrocute. They forcefully inject and electrocute  those grieving the loss of their loved-ones, with major tranquilisers, that cause brain-damage and other disabling. It is not okay to do this to asylum seekers, Greens, hint, hint... I want clarity on that, that you will not send psychiatrists to forcefully drug refugees, like you have promised to do. They are people who have obviously been through trauma and adversity, they are detained and suffering, they are in crisis, they need to talk with people would are empathetic, who listen and enable them to have courage to live, who are trustworthy professionals that will help anchor their crisis in some sort of consensual reality, that allows for diversity. People that will give them hope and ways to cope, so they don't despair and wonder what reality actually is. They are people who really don't need their minds policed by psychiatrists, who will forcefully torture them with drugs and electro-shock, then demand that they agree that they are 'mentally ill' and need to take the 'recommended dose of meds' that is harming them unendurably. That's what psychiatrists do, they don't listen, they experiment and police diversity, unless they specifically state that they are social-psychiatry, that they do psychoanalysis and only prescribe drugs when a patient really wants that. Understand that pollies!
